Terms of Service

These Terms of Service (“Terms”) set forth the conditions for use of the community chat services (the “Service”) provided through Chatmate (the “Site”) by the operator (“we,” “us,” or “Operator”). By using the Service, you (“User” or “you”) agree to these Terms. If you do not agree, do not use the Service.

Article 1 (Application)

• These Terms apply to all relationships between Users and the Operator regarding use of the Service.
• Separate guidelines, rules, or notices posted on the Site form part of these Terms where referenced.

Article 2 (Responsibility for messages and content)

• Users are solely responsible for all messages, files, images, links, and other content they post or transmit (“User Content”).
• We do not warrant the truthfulness, accuracy, legality, completeness, or non-infringement of User Content or third-party rights.
• We are under no obligation to monitor User Content for compliance with these Terms, but we may do so at our discretion.

Article 3 (Moderation: deletion, restriction, and other measures)

• We may delete, hide, move, or restrict access to User Content, or take action against accounts (including warnings, temporary suspension, or permanent ban), if we reasonably determine such action is necessary for operation of the Service, compliance with law, protection of Users, or enforcement of these Terms.
• We are not obligated to preserve or return deleted User Content.

Article 4 (Prohibited conduct)

• Users must not engage in any of the following:
• Violating laws or regulations, or promoting criminal activity
• Harassment, threats, stalking, discrimination, hate speech, or incitement of violence
• Posting obscene, excessively violent, or otherwise offensive content without appropriate context or where prohibited by room rules
• Impersonating another person, the Operator, or staff
• Spamming, unsolicited advertising, pyramid schemes, or excessive commercial solicitation without permission
• Transmitting malware, scraping, automated access that overloads the Service, or circumventing security or access controls
• Collecting or disclosing personal information of others without lawful consent
• Infringing intellectual property, privacy, publicity, or other rights of third parties
• Reverse engineering, decompiling, or attempting to extract source code except as permitted by law
• Interfering with other Users’ use of the Service
• Using the Service for dating solicitation, human trafficking, or sexual exploitation of minors
• Any other conduct we reasonably deem inappropriate for the community

Article 5 (Disclaimer)

• The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee uninterrupted, error-free, or secure operation of the Service.
• We are not liable for disputes between Users or for User Content; Users resolve such matters at their own responsibility and cost.

Article 6 (IP addresses and cookies)

• We may collect and process IP addresses, device identifiers, access logs, and similar technical data for security, analytics, and improvement of the Service.
• We may use cookies and similar technologies as described in our Privacy Policy or cookie notices.
• You may control cookies through your browser settings; disabling cookies may limit some features.

Article 7 (Personal information)

• We handle personal information in accordance with our Privacy Policy. By using the Service, you agree to such processing to the extent described there.

Article 8 (Suspension and termination of use)

• We may suspend or terminate your access to the Service without prior notice if you breach these Terms, if required by law, or if we reasonably determine continuation is inappropriate.
• You may stop using the Service at any time. Provisions that by nature survive termination (including disclaimers, limitations of liability, and dispute resolution) will remain in effect.

Article 9 (Limitation of liability)

• To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from use of or inability to use the Service.
• Where liability cannot be excluded, our aggregate liability for any claim arising from the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD 100), unless mandatory law provides otherwise.

Article 10 (Intellectual property and license)

• All rights in the Site’s design, software, trademarks, and Operator-provided materials belong to us or our licensors.
• You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute User Content solely to operate, promote, and improve the Service and enforce our policies.
• You represent that you have the rights necessary to grant the above license.

Article 11 (Changes to the Service and Terms)

• We may change or discontinue features of the Service with or without notice.
• We may revise these Terms by posting the updated version on the Site. Material changes may be announced by reasonable means (e.g., notice on the Site). Continued use after the effective date constitutes acceptance unless mandatory law requires express consent.

Article 12 (Severability and assignment)

• If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
• We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, subject to applicable law.

Article 13 (Governing law and dispute resolution)

• These Terms are governed by the laws applicable in the jurisdiction of the Operator, without regard to conflict-of-law principles, except where mandatory consumer protections of your country apply.
• Unless mandatory law provides otherwise, courts or tribunals in that jurisdiction have exclusive venue for disputes arising from these Terms or the Service.
